When you create an account with VacYa, you provide us with your personal information such as Name, email address and password.

We collect information about the apps, browsers, and devices you use to access VacYa services, which helps us provide features like automatic product updates.
Traffic data about the communications that take place through our platform (such as calls, team chat, video conferencing, SMS) to enable us to transmit those communications effectively and efficiently.
Network Monitoring data to enable us to maintain the security and agility of our internal networks.
Log data about you when they use the Services, Website or Apps including Internet Protocol ("IP ") address, Internet Service Provider ("ISP"), browser type, referring/exit pages, the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream data to analyze trends in the aggregate and administer the site.

B. How do we use your information?
We use personal information collected via our Services or Apps for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. Any and all use of VacYa Products & Services is subject to and conditioned upon compliance with the following Acceptable Use Policy (“AUP”). If you have an Agreement with VacYa, this AUP is incorporated into and made a part of your Agreement with VacYa.
The Services (including any device, system, network, or account used in connection with the Services, or the VacYa Network) may not be used to:
Illegal activity. Violate any applicable law or regulation of any foreign jurisdiction, including applicable laws regarding the recording of communications.
Infringing activity. Infringe, misappropriate, or otherwise violate VacYa or anyone’s rights (including intellectual property, privacy, personality, publicity, or otherwise; or display or use VacYa’s marks without consent or in violation of VacYa policies.
Auto-dialing; trunking; traffic pumping. Perform auto-dialing or “predictive dialing” in an abusive manner; trunk or forward your VacYa phone or fax number to other numbers that handle multiple simultaneous calls or to a private branch exchange (PBX) or a key system; traffic pumping or access stimulation of calls through the Services or the VacYa Network.
Minors. Exploit or harm minors (e.g., expose them to inappropriate content; ask for personally identifiable information without parental consent).
Interference; transmit viruses. Interfere, inhibit, compromise, or otherwise harm the Services or the VacYa Network (regardless of intent or knowledge); transmit any material that contains viruses, time or logic bombs, Trojan horses, worms, malware, spyware, or any other programs that may be harmful or dangerous.
Objectionable activity. Act in an indecent, offensive, threatening, harassing, defamatory, libelous, fraudulent, malicious, disruptive, tortious, or other objectionable manner; or create a false caller ID identity (i.e., ID spoofing), forge addresses or headers, or otherwise mislead others about a sender’s identity or origin.
Driving; safety. Use while driving or otherwise in an unsafe manner.
Harvest information; spam; bulk messages. Harvest or collect information about third parties or End Users without consent; send bulk communications or other content without the recipient’s consent.
Excessive or unauthorized use. Use any device, system, network, account, plan, or the Services in an unauthorized manner or in excess of reasonable business use.
Circumvent compliance or security. Take advantage of, bypass, exploit, defeat, disable, or otherwise circumvent limitations of the Services, security mechanisms, or compliance with this AUP or any law.
Interception. Intercept, capture, sniff, monitor, modify, emulate, decrypt, or redirect any communication or data for any purpose.
Resale Prohibited. Customer may not sell, resell, sublease, assign, license, or sublicense the Services or any component thereof or use or offer the same on a service-bureau or time-sharing basis.
High Risk Use Prohibited. THE SERVICES ARE NOT DESIGNED, MANUFACTURED, INTENDED, OR RECOMMENDED FOR USE FOR ANY HIGH-RISK OR FAIL-SAFE PURPOSE OR ACTIVITY OR IN ANY ENVIRONMENT WHERE FAILURE, INTERRUPTION, MALFUNCTION, ERROR, OR UNAVAILABILITY COULD RESULT IN PHYSICAL HARM OR PERSONAL INJURY, DEATH OR DISMEMBERMENT, OR PROPERTY OR ENVIRONMENTAL DAMAGE. CUSTOMER SHALL NOT USE THE SERVICES FOR ANY SUCH PURPOSE OR ACTIVITY OR IN ANY SUCH ENVIRONMENT.
The list above is not exhaustive or exclusive. For purposes of this AUP, “End User” means an individual user of the Services, and may be a natural person, and may include but is not limited to a Customer’s employees, consultants, clients, external users, invitees, contractors and agents. Except as otherwise provided, terms defined in the Agreement have the same meanings when used in this AUP.
VacYa may act immediately and without notice to suspend or terminate the Services if, in VacYa sole discretion, Customer’s or its End Users’ use of the Services violates the terms of this Acceptable Use Policy.
Customer may cancel any services purchased under this Agreement with written notice to VacYa within thirty (30) days of the date in which the purchase becomes effective. Except as otherwise provided in the Agreement between the Parties, in the event of a timely cancelation, Customer shall not owe any fees or charges for the services being canceled in respect of any period subsequent to the date of such written notice (except those arising from continued Usage), and shall be entitled to a pro-rata refund of any prepaid and unused fees for the services subject to the cancelation. All purchases are final after 30 days.

2. Claims regarding copyright and other intellectual property infringement
Notice of Claimed Infringement In an effort to prevent unauthorized use of intellectual property on our Website, our browser app, and our mobile app, and pursuant to the section 40 of Copyright Act, 1957 (14 of 1957) we have implemented procedures for receiving written notification of claimed infringements of IP Rights. If you believe in good faith that your IP Rights have been infringed, you may complete and submit a written communication which contains the following information:
- A signature of the person authorized to act on behalf of the owner of the IP Rights.
- A description of the work that you claim has been infringed.
- A description specifying the location on our website of the material that you claim is infringing.
- Your telephone number and e-mail address.
- A statement by you that you have a good faith belief that the disputed use is not authorized by the intellectual property owner, its agent, or the law.
- A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the intellectual property owner’s behalf.

End-User License Agreement (EULA) of VacYa
This End-User License Agreement ("EULA") is a legal agreement between you and VacYa Global Networks Pvt Ltd
This EULA agreement governs your acquisition and use of our VacYa software ("Software") directly from VacYa Global Networks Pvt Ltd or indirectly through a VacYa Global Networks Pvt Ltd authorized reseller or distributor (a "Reseller").
Please read this EULA agreement carefully before completing the installation process and using the VacYa software. It provides a license to use the VacYa software and contains warranty information and liability disclaimers.
If you register for a free trial of the VacYa software, this EULA agreement will also govern that trial. By clicking "accept" or installing and/or using the VacYa software, you are confirming your acceptance of the Software and agreeing to become bound by the terms of this EULA agreement.
If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use the Software, and you must not accept this EULA agreement.
This EULA agreement shall apply only to the Software supplied by VacYa Global Networks Pvt Ltd herewith regardless of whether other software is referred to or described herein. The terms also apply to any VacYa Global Networks Pvt Ltd updates, supplements, Internet-based services, and support services for the Software, unless other terms accompany those items on delivery. If so, those terms apply. This EULA was created by EULA Template for VacYa.
VacYa Global Networks Pvt Ltd hereby grants you a personal, non-transferable, non-exclusive licence to use the VacYa software on your devices in accordance with the terms of this EULA agreement.
You are permitted to load the VacYa software (for example a PC, laptop, mobile or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of the VacYa software.
You are not permitted to:
Edit, alter, modify, adapt, translate or otherwise change the whole or any part of the Software nor permit the whole or any part of the Software to be combined with or become incorporated in any other software, nor decompile, disassemble or reverse engineer the Software or attempt to do any such things
Reproduce, copy, distribute, resell or otherwise use the Software for any commercial purpose
Allow any third party to use the Software on behalf of or for the benefit of any third party
Use the Software in any way which breaches any applicable local, national or international law
Use the Software for any purpose that VacYa Global Networks Pvt Ltd considers is a breach of this EULA agreement
Intellectual Property and Ownership
VacYa Global Networks Pvt Ltd shall at all times retain ownership of the Software as originally downloaded by you and all subsequent downloads of the Software by you. The Software (and the copyright, and other intellectual property rights of whatever nature in the Software, including any modifications made thereto) are and shall remain the property of VacYa Global Networks Pvt Ltd.
VacYa Global Networks Pvt Ltd reserves the right to grant licences to use the Software to third parties.
This EULA agreement is effective from the date you first use the Software and shall continue until terminated. You may terminate it at any time upon written notice to VacYa Global Networks Pvt Ltd.
It will also terminate immediately if you fail to comply with any term of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate and you agree to stop all access and use of the Software. The provisions that by their nature continue and survive will survive any termination of this EULA agreement.
This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of India.
